The plaintiff has to present their claim to a judge. If there is no basis for their claim then they have no case.

A doctor would not operate on a person, who has no injury. If there is no medical procedure, there is no doctor bills, if there's no doctor bills there's no damages.

It's not that easy to fraudulently conjure a case.
